These terms are issued by Pot Black (NZ) Ltd (“PotBlack”) and are effective from January 1^st, 2019. Please read these Terms and conditions of trade carefully.

These terms cover the use of our website – potblack.co.nz.

Use includes visits to our site, purchases on our site, participation in our database and promotions. These terms of use apply to you when you use our website. Please read these terms carefully – if you need to refer to them again they can be accessed from the link at the bottom of any page.

The website www.potblack.co.nz is owned and operated by Pot Black (NZ) Ltd (“PotBlack).

By engaging PotBlack or placing an order via www.potblack.co.nz  you agree to be bound by these terms and conditions. These terms and conditions are subject to change without notice. The sale or supply of all products and services from PotBlack is subject to these terms and conditions.

While we endeavour to supply accurate information on this site, errors and omissions may occur. Pot Black (NZ) Ltd (“PotBlack”) does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site.

PotBlack reserves the right to make changes to the content on this site at any time and without notice.

To the extent permitted by New Zealand law, PotBlack makes no warranties in relation to the merchantability, fitness for purpose, freedom from computer virus, accuracy or availability of this web site or any other web site.

Ordering goods and services from us

When you place an order with us, you are making an offer to buy goods or services. An order is placed on our website via adding a product to the shopping cart and proceeding through our checkout process. The checkout process includes giving us delivery and any other relevant details for your order, entering payment information and submitting your order. The final step consists of a confirmation page with full details of your order, which you are able to print as a receipt of your order

We do not supply trade quantities and reserve the right to limit the number of an item customers can purchase in a single transaction.

We will send you an e-mail to confirm that we have received and accepted your order, which indicates that your order has been accepted and you may not cancel it.

We will take payment from you when we accept your order.

Refusing or cancelling an order

In the unlikely event that the goods or services ordered are no longer available we reserve the right to refuse or cancel an order.

We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to be placed for commercial purposes, e.g. any kind of reseller. We also reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently.

While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.

Our right to cancel orders applies to orders that have been accepted.

Payment

PotBlack accepts payment by a number of convenient options; the available options are presented as you process through the ‘check out’ when purchasing online.

• By Credit Card – Visa, MasterCard or Q Card
• By Bank Transfer; Payment must be received before the order is dispatched
• Oxipay
• On Account; Credit terms and conditions apply

When placing a phone order we accept “card not present” (Visa, MasterCard, Q Card)

Website and Credit Card Security

We want you to have a safe and secure shopping experience online. All payments via our sites are processed using Payment Express PxPay 2.0. PxPay2.0 provides a financially secure and compliant solution with a SSL (Secure Socket Layer) protocol, whereby sensitive information is encrypted to protect your privacy.

You can help to protect your details from unauthorised access by logging out each time you finish using the site, particularly if you are doing so from a public or shared computer.

For security purposes certain transactions may require proof of identification.

Refunds

We apologise if you have received a product that is faulty, or if you have received the wrong product. You are welcome to an exchange or refund.

Should you have any issues with your purchase, you are able to return your product to us under our standard terms. 

Any refunds made by PotBlack will be made to the card that you used to pay for your goods and may take up to seven (7) days.  

Pricing

All prices listed on www.potblack.co.nz are in New Zealand dollars and are inclusive of GST. Please note that we reserve the right to alter prices on our websites at any time for any reason. Online and in store pricing may differ.

Returns, Refunds and Cancellations

The Consumer Guarantees Act and Fair Trading Act provide the basis for PotBlacks Returns Policy.  For a product to be returned under our policy, that product must be in a resalable condition unless faulty or otherwise defective.

Any unopened items still in its original packaging can be returned to PotBlack within SEVEN days of the receipt of your order for an exchange or full refund. You are responsible for any costs associated with returning a product to PotBlack Ltd. Once the product has been returned your refund will be processed. Please ensure all returns are packaged adequately as refunds will not be issued on damaged items.

If PotBlack has sent you the incorrect items, we will send you the correct item along with a courier ticket for the return.

You can cancel any order prior to it being dispatched and receive a full refund. Please contact us immediately via telephone (0800 476 825) or email sales@potblack.co.nz to inform us of the cancellation request, please included the order number and your contact details. Once your request has been completed, you will receive a refund via the payment method or credit card used for the original order. Pool Table purchases may incur a cancellation fee.

Gift cards cannot be returned because the gift card value is activated at the time of purchase. Gift cards are non-refundable and cannot be redeemed for cash.

If a product is deemed unsatisfactory, we can offer to exchange it for another one (ie: a different colour or size) or another product for the same value.

You can courier the item/s back to us, please note that this is at your cost. If you wish to proceed with this option please contact us and we will provide the information required to send it back to us.

Proof of purchase is required in order to get an exchange or a refund. You will receive a refund for the product but not the delivery fee.

Faulty Products

Under the Consumer Guarantees Act you are entitled to have your product repaired, replaced or refunded.

Damaged Product 

If you suspect your product has been damaged during delivery please do not throw away the parcel or cover in which the product came as the delivery company will need to inspect it. Please contact us on 0800 476825 Monday – Friday 8.30am – 5pm and we will organise the return of the product for inspection and will endeavour to send you a replacement as soon as possible.

Backorders

If a product is temporarily out of stock it will be placed on backorder and you will be notified. If an item on backorder cannot be sourced within 30 – 40 working days we will give you the option of a refund for that item.

PotBlack imports some products from International Suppliers. If there is a delay in the importation of these products due to an event outside of our control then PotBlack will endeavour to take all practicable steps to minimise the effect of this delay on you and will keep you informed. Provided we do this we will not be liable, however if there is a risk of a substantial delay for any goods you have paid for but not received, you will be offered a refund or an alternative product that is available.

If you wish to cancel an order for any backordered item please contact us immediately to arrange a refund.

In the unlikely event that a purchased product is discontinued or is not available for an extended period we will contact you and discuss your available options.

 Clearance Items

Occasionally our stock level information is incorrect; we work to ensure this doesn’t happen but if a Clearance item is out of stock you will be notified and refunded.

  Gift card usage

Pre-paid gift certificates are redeemable for goods sold at PotBlack. Lost or stolen certificates are the responsibility of the holder. Gift certificates cannot be used as payment on Finance balances. Gift cards expire 24 months after the date of issue. Gift cards cannot be used online.

Delivery

Delivery lead times do vary – however our objective is to process all orders with 1 to 3 working days. If your order is required before a certain date please advise us.

Once an order has been dispatched, you should receive it within the following time frame;
Deliveries to PO Box addresses are not accepted.

• Hamilton; 1 -2 business days
• North Island- Non Rural; 2 – 3 Business days
• Rest of New Zealand-Non Rural; 3 – 4 business days
• Rural Deliveries; 3 – 6 business days

PotBlack sends all orders using track and trace and ‘SIGNATURE REQUIRED’ methods. If you choose to have an order sent out ‘No Signature Required’ or instructions to leave, then the order will not be covered by insurance and will not be replaced or reimbursed in the unlikely event of lost or damage.

To ensure successful delivery, please provide a delivery address where someone will be present during business hours to sign for the receipt of your package. You can track your order by clicking on the link in the dispatch email

All orders will be sent out to the shipping address that you confirmed at the time of ordering. It is your responsibility to ensure that delivery information is accurate and complete. If you are unsure of the correct address format please consult New Zealand Post

 If goods are lost or damaged in transit, please contact us on 0800 476 825 within 7 business days.

We will use this delivery information to make a claim against our courier company. We will offer you the choice of a replacement or a full refund, once we have received confirmation from our courier company that delivery was not successful.

Accessing our service

Other than connecting to PotBlack website by HTTP requests using a web browser, you may not gain access to PotBlack website servers. You agree not to disrupt, modify or interfere with our websites or services and their associated software, hardware and servers in any way. You also agree not to modify any content or service on PotBlack websites. Furthermore, you agree not to use our sites in any inappropriate or unlawful way.
